After you've printed the petition, do not sign it yet. You will need to bring a valid photo ID and the document to a notary and sign the document in front of them. Notaries are typically available through your bank for free, or may be available through your local library for $1 per document.

VERIFIED PETITION TO MODIFY BIRTH CERTIFICATE

COMES NOW (full legal name), pro se, and petitions this Honorable Court to grant a modification in Petitioner's birth certificate, and in support therefor states as follows:

  1. I reside in (filing county) County, Alabama, such that jurisdiction and venue are proper in this Court.
  2. I am over eighteen (18) years of age.
  3. I have undergone all medically-indicated treatments, procedures and/or surgeries that are irreversible for the purpose of gender transition from that of a (gender on birth certificate, male/female) to a (gender desired on birth certificate).
  4. In support of this Petition, I have attached hereto a letter from my medical provider, Dr. (doctor) (see Exhibit A).
  5. I have previously filed a petition to have my name legally changed, and said Petition was granted by (name change county) (name change county output) (Case No. (name change case number) via Order Changing Name entered (name change case date), and a copy of said Decree is attached hereto (see Exhibit B).
  6. Ala. Code (1975) Section 22-9a-19 permits an individual whose sex has been changed by surgical procedure and who has obtained a legal name change to have a court order their gender marker reflect their new sex.
  7. This petition is not submitted with the intention of defrauding another of any rights.

WHEREFORE, PREMISES CONSIDERED, I respectfully request that this Court issue an Order indicating that Petitioner has undergone all medically-indicated treatments, procedures and/or surgeries that are irreversible for the purpose of gender transition from that of a (gender on birth certificate, male/female) to a (gender desired on birth certificate) and that Petitioner has, by Order of the Court, had (his/her) name changed pursuant to the requirements of issuing a new birth certificate reflecting the foregoing changes.
